These Terms of Service ("Terms") are an agreement between you and Xenon Studios ("Xenon Studios," "we," "us"), an independent web studio that operates remotely and provides digital systems to local service businesses across the United States. They apply to this website and to every website, quote portal, landing page, hosting service, and related service we provide (the "Services"). By ordering, paying for, or using the Services, you agree to these Terms. If you're agreeing for a business, you confirm you're authorized to bind that business.

1. Our services

We offer the packages described on our Pricing page. Each package has a fixed scope: what's listed is what's included. Work outside that scope, such as extra pages, custom features, or ongoing content changes, is quoted separately and starts only after you approve the quote in writing (email is fine).

2. Prices and payment

• Prices are in US dollars and are one-time setup fees unless stated otherwise.
• Payment is due as stated on your invoice. We start work once payment is received.
• Prices don't include sales tax or other taxes. We add these where the law requires.
• Unless your invoice says otherwise, prices don't include domain name registration or renewal, or paid third-party services you choose to add.
• We may change our prices at any time. Changes never affect an order you've already paid for.

3. Delivery

We typically deliver within 2 business days. This is an estimate, not a guaranteed deadline. Business days are Monday through Friday, excluding US federal holidays. The timeline starts once we've received both your payment and everything we need to build your site (for example your business name, services, service area, logo, and where you want leads sent). If we need more information from you, the timeline pauses until you send it.

5-business-day refund: If your site isn't delivered within 5 business days of the timeline starting, you're entitled to a full refund. Just email us to request it.

4. Review and corrections

After handover, you have 14 days to tell us about anything that doesn't match what your package includes, or any mistakes in the information we used (for example a wrong phone number). We'll fix those at no charge. After 14 days, the work is considered accepted. Later changes may be quoted separately.

5. Cancellations and refunds

• If you cancel before we start building, we'll refund your payment in full.
• If your site isn't delivered within 5 business days, as described in section 3, you're entitled to a full refund.
• If we can't deliver what your package includes and can't fix it within 14 days of you telling us, you can ask for a full refund.
• Otherwise, setup fees are non-refundable once your build has been delivered.
• Nothing in this section limits any refund right you have under applicable law.

6. Preview builds

We sometimes prepare a preview of a site for a business before it orders, using publicly available information about that business. A preview is a private sample shared only with that business. We don't publish it or let search engines index it, and it doesn't mean that business is our client or endorses us. If the business doesn't order, we take the preview down, and we'll do so promptly on request. If you don't want to hear from us again, tell us and we'll stop contacting you.

7. Hosting

• Packages that include hosting (including "Global Edge Hosting" and "Lifetime Static Edge Hosting") include hosting of the site we built for you, at no monthly charge, for as long as Xenon Studios operates its hosting service. "Lifetime" refers to the life of that service, not the life of any person or business.
• If we ever discontinue hosting, we'll give you at least 60 days' notice by email and provide your site files so you can move them to another host.
• We use reasonable efforts to keep sites online and secure, but we don't guarantee uninterrupted availability. Hosting relies on third-party infrastructure we don't control.
• We may suspend or remove a site that contains illegal, infringing, deceptive, or harmful content, is used for spam or abuse, creates a security risk, or whose payment was reversed or charged back. Where practical, we'll contact you first and give you a chance to fix the problem.
• Hosting covers your site as delivered. Content updates and redesigns are separate services.

8. Lead forwarding

• We forward submissions from your site's forms to the phone number and email address you give us. Delivery depends on third parties (mobile carriers, SMS providers, and email providers), and messages can be delayed, filtered as spam, or fail.
• We aren't responsible for leads that are delayed, lost, or not delivered for reasons outside our reasonable control. Check your inbox and spam folder regularly and tell us promptly if leads stop arriving.
• Keep your contact details up to date with us. We aren't responsible for leads sent to an outdated number or address you didn't ask us to change.

9. Your responsibilities

You're responsible for:

• Giving us accurate information about your business, including licenses, insurance, certifications, service areas, prices, and any claims you ask us to publish. We publish what you give us and don't verify it.
• Having the rights to everything you give us to use, such as logos, photos, text, and trademarks.
• Following the laws that apply to your business, including any requirement to show license numbers in advertising, advertising and consumer protection laws, and privacy laws that cover your customers' information.
• How you contact people who send you quote requests. If you call or text leads, especially using automated tools, you're responsible for getting any consent the law requires, including under the Telephone Consumer Protection Act (TCPA), and for honoring opt-out requests. Our forms can include standard consent wording, but that doesn't make us responsible for how you use your leads.
• Not using the Services for anything illegal, deceptive, or harmful.

10. Reviews and third-party platforms

Review badges and Google-related features display information from third-party platforms such as Google. We don't write, edit, or selectively hide reviews, and we won't create fake or paid reviews; you agree not to ask us to. Third-party platforms can change or end their features at any time, which may affect these features, and their own terms apply to your accounts with them.

11. Ownership

• You keep ownership of everything you give us, including your logo, photos, text, and business information.
• Once you've paid in full, you own the custom text and design created specifically for your site. We keep ownership of our underlying code, templates, and tools, and give you a permanent, non-exclusive license to use them as part of your site.
• If you register a domain yourself, it's yours. If we register a domain for you, we register it in your name or transfer it to you on request.
• You can ask for a copy of your site files at any time.
• We may show your site in our portfolio. If you'd prefer we didn't, tell us and we'll remove it.

12. No guaranteed results

We build sites designed to capture leads, but we don't guarantee any particular result, including search rankings, indexing, map placement, traffic, number of leads, or revenue. Search engines and other platforms control their own rankings and policies, which change often.

13. Disclaimer of warranties

Except as expressly stated in these Terms, the Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the fullest extent permitted by law, (a) we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, leads, or business opportunities; and (b) our total liability for any claim relating to the Services is limited to the amount you paid us for the Services that the claim relates to.

Some laws don't allow these limits, so they may not fully apply to you.

15. Indemnity

You agree to defend and indemnify Xenon Studios against third-party claims, including reasonable attorneys' fees, arising from content or information you gave us, your business practices (including how you contact leads), or your violation of these Terms or the law.

16. Ending the Services

You can stop using the Services at any time. We may end or suspend the Services if you seriously breach these Terms. Sections 9 through 17 continue to apply after the Services end. If we end hosting because of a breach, we'll still provide your site files on request unless the law prohibits it.

17. Governing law and disputes

These Terms are governed by the laws of the US state where your business is located. If a dispute comes up, please email us first; we'll try in good faith to resolve it within 30 days. If we can't, either of us may bring a claim in the courts of the county where your business is located, including small claims court if the claim qualifies.

18. Changes to these Terms

We may update these Terms. The version posted when you place an order applies to that order. Updates will appear on this page with a new "Last updated" date.

This policy explains how Xenon Studios ("we," "us") handles personal information on this website and in the Services described in our Terms of Service.

1. Information we collect

• Information you send us. When you email us or place an order, we receive your name, email address, phone number, business details, and anything else you include.
• Information for your build. Business information, logos, photos, and the phone number and email address where you want leads sent.
• Quote requests on our clients' sites. When someone fills out a quote form on a site we host for a client, we receive what they enter (typically name, phone number, ZIP code, and project details) so we can forward it to that business.
• Technical information. Our hosting providers may automatically log technical details such as IP address, browser type, and pages requested, to keep sites secure and running.
• Payment information. If you pay by card, your payment is handled by our payment processor. We don't receive or store your full card number.

2. Cookies and analytics

This website doesn't use advertising or analytics cookies, and it doesn't track you across other websites. It loads fonts from Google Fonts, so your browser connects to Google's servers and Google receives your IP address, as described in Google's privacy policy. If we add analytics in the future, we'll update this policy first.

3. How we use information

• To build, deliver, and host the Services, and to forward leads.
• To communicate with you about orders, support, and changes to the Services.
• To handle invoicing and keep records required for tax and legal purposes.
• To keep the Services secure and prevent fraud and abuse.

We don't sell personal information, and we don't share it for targeted advertising.

4. Quote requests we handle for clients

We process quote requests on behalf of the business whose site they were submitted on. That business decides how to use them and is responsible for its own privacy practices. We use quote requests only to deliver them to that business and to troubleshoot delivery, and we keep stored copies only as long as needed for that. If you submitted a quote request and want it corrected or deleted, contact the business you sent it to. You can also email us and we'll help.

5. Who we share information with

• Service providers that help us run the Services, such as hosting, email, SMS delivery, and payment processing, only as needed for them to do that work.
• The client business, for quote requests submitted on its site.
• Authorities or others when required by law, or to protect our rights, our clients, or the public.
• A buyer or successor if our business is sold or merged, subject to this policy.

6. Where information is processed

We operate remotely, and our service providers run systems in multiple countries. Information you send us may be stored and processed outside your state or country, where data protection laws may differ from yours. Wherever it's processed, we protect it as described in this policy.

7. How long we keep information

We keep client and order records for as long as we provide Services to you and as long as needed afterward for tax, accounting, and legal purposes. Then we delete them.

8. Security

We use reasonable safeguards, including encrypted HTTPS connections and limiting access to people who need it. No method of transmission or storage is completely secure. If a breach affects your personal information, we'll notify you as required by law.

9. Your choices and rights

• You can ask us to tell you what personal information we have about you, correct it, or delete it, by emailing billing@xenonstudios.site. We may need to confirm your identity first.
• You can opt out of marketing emails at any time by replying to tell us, or by using the unsubscribe option in the email.
• Depending on where you live, you may have additional rights under state law. We respond to requests within 45 days and won't treat you differently for making one.

10. Children

Our Services are for businesses and aren't directed to children under 13. We don't knowingly collect personal information from children.
